The following agreement (“Agreement”) applies to users who register on or after March 23, 2021.

1. Introduction

Welcome to My Tower! By using the services (“Services”) offered on My Tower platforms (mytowerapp.eu and other related websites where this Agreement appears), including services available through the My Tower application (“Application”), you agree to the terms outlined below, including terms linked via hyperlinks and general policies applicable to the websites of our subsidiaries and foreign branches.

If you reside in the European Union, you are entering into an agreement with My Tower Europe Spółka z ograniczoną odpowiedzialnością, based in Kraków, Poland, at ul. Sukiennicza 8/U7, 31-069 Kraków, registered in the National Court Register under number KRS: 0000882769, REGON: 388128682, NIP: 6762592315, with a share capital of PLN 5,000.00, hereinafter referred to as “MTE”. Contact customer support via email: support@mytowerapp.eu.

Before registering, users must read and accept all the terms and conditions contained in this User Agreement, the Privacy Policy, and any linked documents. If you do not agree with our policies, do not use the Application, websites, or Services. We strongly recommend reading this Agreement and reviewing the linked information.

The provisions of this Agreement concerning consumers also apply to individuals entering into this Agreement directly related to their business, provided that it is not of a professional nature for them.

2. Definitions

• Application Services – services available in buildings that use MTE software, allowing Users to purchase services provided by MTE and third-party providers (“Service Providers”).

• User – any person using My Tower, regardless of whether they are a business user.

• Business User – any individual or legal entity acting for commercial or professional purposes, offering goods or services via My Tower to consumers in the EU.

3. Rules and Changes to the Agreement

The following rules and all other policies available on My Tower are part of this Agreement and include additional conditions for specific services: www.mytowerapp.eu

We may update this Agreement at any time by notifying users via email and posting the revised version at www.mytowerapp.eu/user-agreement.

The new version applies immediately to newly registered users. For existing users, it becomes binding 15 days after notification or upon acceptance. Privacy Policy changes follow different rules (30 days). No changes may be made in any form other than specified above, except in a written agreement signed by both the User and MTE (electronic form with clear confirmation counts).

Updated “Rules” become effective 15 days after posting on My Tower (30 days for the Privacy Policy). If the user disagrees, they should stop using My Tower. Acceptance of the Service Terms (“Service Terms”) will be required before purchasing each Service.

Users who do not accept the updated Agreement may terminate it, as described in the “Account Closure” section.

Business users may withdraw from the Agreement until the updated Terms take effect by deleting their account.

4. Using My Tower

You may not use the platform if:

• You cannot legally enter binding contracts,

• You are under 18,

• You are suspended from our services.

Users must pay for services unless otherwise provided in our policies.

Service Providers may not refuse to provide services unless users fail to meet required conditions or cannot be verified.

Users and Providers must not:

• Bypass fee policies or manipulate the billing process,

• Violate any laws, third-party rights, or our policies,

• Transfer their account without MTE’s consent,

• Spread viruses or harmful technologies,

• Copy, modify, or distribute content protected by copyright or trademarks,

• Collect or transmit user information without consent.

You authorize us to use translation tools to localize content and communication where available. Accuracy is not guaranteed.

5. Misuse of My Tower

MTE may limit, suspend, or terminate services or accounts, remove or delay content, or take technical/legal steps if users or Providers violate rules or may expose us to legal liability.

My Tower notifies Providers via email before taking restrictive action unless urgent action is required.

At least 1 month’s notice will be given before account removal, except in cases of:

• Legal obligations requiring immediate action,

• Enforcement of national laws aligned with EU law,

• Repeated violations of service terms by the Provider.

6. Fees and Services

Using the Application is free for Users. MTE charges for other services, with clear information and acceptance required before payment. Fees are listed in the Service Terms and may change. Updated fees apply after refresh in the Application. Promotional pricing may be applied temporarily.

Users and Providers must settle payments on time via accepted methods. By accepting this Agreement, you authorize My Tower to charge your selected payment method. If payment fails, you’re responsible for the outstanding amount.

If we lawfully restrict services, you are not entitled to a refund unless the service was not delivered as agreed.

7. Additional Services

To enhance user experience, My Tower may offer its own or third-party services. Full details are at www.mytowerapp.eu.

8. Listing Services by Providers

By listing services, the Provider agrees that:

• Their service offer will be published within 5 business days,

• My Tower may modify or remove content that violates its rules,

• They are responsible for accuracy, legality, and content,

• MTE may amend service descriptions,

• Some features are only available for specific services or countries,

• Service listings appear regardless of user sort preferences.

9. Content Provided by Providers

By submitting content, the Provider grants MTE a non-exclusive, royalty-free, sublicensable, worldwide license to use it across all media. This includes rights to:

• Copy, reproduce, display, transmit, adapt, translate, sublicense,

• Use in databases and on any medium or platform.

This license lasts for the duration of intellectual property rights or until content is removed.

The Provider waives any property rights and agrees not to exercise personal rights over the content.

The Provider guarantees that:

• Content complies with laws and does not infringe third-party rights,

• They indemnify My Tower against legal claims from rights holders or defamation.

MTE may also offer third-party content to Providers for use in the Application. Access may be revoked if licensing is lost.

Although we strive for reliable information, we do not guarantee the accuracy or completeness of third-party or Provider content. Providers remain responsible for the correctness of their listings.

10. Liability

My Tower is not liable for Provider content or services. MTE only enables their offering and does not control transactions. We do not guarantee quality, legality, or fulfillment of services.

This Agreement does not limit our liability for intentional harm.

We disclaim liability for negligence, reputation damage, or loss of profit, except where not permitted by law. These exclusions do not apply to consumers.

Our liability to Providers is limited to MTE’s annual revenue from that Provider, not exceeding PLN 5,000. This does not apply to consumers.

Users must not use software for automated access without written consent. Do not share login or authentication data or devices with others.

Additionally, you agree not to:

• Copy, modify, or publicly share any My Tower content without prior consent,

• Disrupt or attempt to disrupt platform functionality.
